Government to confirm ban on combustible materials on high rises #ukhousing

In his speech to the Conservative Party conference, housing secretary James Brokenshire will announce the ban on all combustible materials on the outside of high-rise buildings.

The government, he will say, will change building regulations to ban the use of combustible materials on high-rise residential buildings, hospitals, care homes and student accommodation.

High rises, in the context of these plans, refers to buildings over 18 metres.

Inside Housing understands the government is aiming to bring in the changes to building regulations in late autumn.

Mr Brokenshire will tell his party’s conference: “It’s been over a year since the tragedy of the Grenfell Tower fire. This unimaginable horror has rightly shocked us all and underlined the need to do all that we can to see that such a disaster cannot happen again.

“My work with Grenfell United and the wider community has been hugely helpful in keeping this issue right at the top of the government’s agenda.

“And that is why today I can confirm that I will change the building regulations to ban the use of combustible cladding for all high-rise residential buildings, hospitals, care homes and student accommodation.”

The ban will not apply retrospectively.

Work on removing combustible materials from existing high-rise buildings has progressed slowly since the Grenfell Tower fire last year, which killed 72 people.

According to the government’s latest figures, there are 468 high-rise residential and publicly owned buildings with dangerous aluminium cladding. Of these, only 32 have finished remediation work.

Out of the total, 159 buildings are in the social housing sector, 295 are private sector buildings and 14 are publicly owned buildings.

These figures, however, only apply to buildings with cladding made from aluminium composite material, the same kind that was used on Grenfell Tower.

They do not account for all the buildings using any other kind of combustible cladding, or combustible insulation, window panels or balconies.

The government agreed to a ban on combustibles following pressure from Grenfell United in May this year.

It had previously been intending to follow the recommendation of the Hackitt Review of building regulations, which suggested tweaks to the current process of testing and desktop studies, but no outright bans.

Ahmed Elgwahry who lost his mother and sister in the fire and has been leading the survivor’s campaign for a ban on combustible materials for the Grenfell United group said:

“Everyone who watched the tower burn that night knows the catastrophic consequences of these combustible materials. They should never have been on Grenfell. It is heartbreakingly too late for our families, but we are one step closer to making sure other families across the country can go to bed at night safe in their homes.
“There is more to do. In the past, companies have used loopholes in the testing process to pass dangerous materials off as safe.
“These loopholes must be closed to ensure the ban works in practise. And the momentum must remain until dangerous cladding is removed from every block in the country.”

The quote from Mr Elgwahry was changed at his request from a longer version originally published.
He requested the change because when he welcomed the government’s step, he understood properties holding vulnerable people - such as hospitals and care homes - would be included in the ban regardless of height.
When the full information was published by government, it transpired that this was not the case.

In the days following the Grenfell Tower fire on 14 June 2017, Inside Housing launched the Never Again campaign to call for immediate action to implement the learning from the Lakanal House fire, and a commitment to act – without delay – on learning from the Grenfell Tower tragedy as it becomes available.

One year on, we have extended the campaign asks in the light of information that has emerged since.

Here are our updated asks:

GOVERNMENT

  • Act on the recommendations from Dame Judith Hackitt’s review of building regulations to tower blocks of 18m and higher. Commit to producing a timetable for implementation by autumn 2018, setting out how recommendations that don’t require legislative change can be taken forward without delay
  • Follow through on commitments to fully ban combustible materials on high-rise buildings
  • Unequivocally ban desktop studies
  • Review recommendations and advice given to ministers after the Lakanal House fire and implement necessary changes
  • Publish details of all tower blocks with dangerous cladding, insulation and/or external panels and commit to a timeline for remedial works. Provide necessary guidance to landlords to ensure that removal work can begin on all affected private and social residential blocks by the end of 2018. Complete quarterly follow-up checks to ensure that remedial work is completed to the required standard. Checks should not cease until all work is completed.
  • Stand by the prime minister’s commitment to fully fund the removal of dangerous cladding
  • Fund the retrofitting of sprinkler systems in all tower blocks across the UK (except where there are specific structural reasons not to do so)
  • Explore options for requiring remedial works on affected private sector residential tower blocks

LOCAL GOVERNMENT

  • Take immediate action to identify privately owned residential tower blocks so that cladding and external panels can be checked

LANDLORDS

  • Publish details of the combinations of insulations and cladding materials for all high rise blocks
  • Commit to ensuring that removal work begins on all blocks with dangerous materials by the end of 2018 upon receipt of guidance from government
  • Publish current fire risk assessments for all high rise blocks (the Information Commissioner has required councils to publish and recommended that housing associations should do the same). Work with peers to share learning from assessments and improve and clarify the risk assessment model.
  • Commit to renewing assessments annually and after major repair or cladding work is carried out. Ensure assessments consider the external features of blocks. Always use an appropriate, qualified expert to conduct assessments.
  • Review and update evacuation policies and ‘stay put’ advice in the light of risk assessments, and communicate clearly to residents
  • Adopt Dame Judith Hackitt’s recommended approach for listening to and addressing tenants’ concerns, with immediate effect
